DECREE OF THE MINISTER OF AGRICULTURE

CONCERNING
BAN ON THE ENTRY OF RUMINANSIA BREEDING ANIMALS AND THEIR PRODUCTS
FROM COUNTRIES INFECTED
BY BOVINE SPONGIOFORM ENCELPHALOPATHY (BSE)
THE MINISTRY OF AGRICULTURE,
Considering:
- a. that scientific evidence has stated the relationship between the cause of the decease of Bovine Spongioform Encephalopathy (BSE) and Creutzfell Jacob Decease of new variant (nv CJD) attacking human being;
- b. that based on data of Office International des Epizooties, the number of countries infected by BSE, the number of countries infected by BSE experiences an increase, apart from the addition to the kinds of materials having risk capable of transmitting the decease of BSE;
- c. that in relation to matters mentioned above, to prevent the decease of BSE in ruminansia breeding animals from spreading to the territory of the Unitary State of the Republic of Indonesia and also in the framework of maintaining the territory of Indonesia to remain free of the decease of BSE, it is necessary to stipulate ban on the entry of ruminansia breeding animals and their products from countries infected by the decease of BSE into the territory of the Unitary State of the Republic of Indonesia by a decree of the Minister of Agriculture.

- 3. Law No. 7/1996 on Foods (Statute Book of 1996 No. 99, Supplement to Statute Book No. 3656);
- 4. Law No. 8/1999 on Consumers Protection (Statute Book of 1999 No. 33, Supplement to Statute Book No. 3817);
- 5. Government Regulation No. 15/1977 on Rejection, Prevention, Elimination and Medical Treatment of Animal Decease (Statute Book of 1977 No. 20, Supplement to Statute Book No. 3101);
- 6. Government Regulation No. 82/2000 on Quarantine of Animals (Statute Book of 2000 No. 161, Supplement to Statute Book No. 4002);
- 7. Presidential Decree No. 228/M/2001 on the Establishment of the Cabinet of Mutual Cooperation (Gotong Royong);
- 8. Decree of the Minister of Agriculture No. 284/Kpts/OP.1983 on the Appointment of Official Receiving Authority to Regulate Rejection, Prevention, Elimination and Medical Treatment of Animal Decease;
- 9. Decree of the Minister of Agriculture No. 01/Kpts/OT.210/6/2001 on the Organization and Working System of the Ministry of Agriculture juncto Decree of the Minister of Agriculture No. 354/Kpts/OT.210/2001;
- 10. Decree of the Minister of Agriculture No. 99/Kpts/OT.210/2/2001 on the Completion of the Organization and Working System of the Ministry of Agriculture juncto Decree of the Minister of Agriculture No. 392/Kpts/OT.210/7/2001.
Observing:
- 1. Circular of the Director General of the Fostering of Animal Breeding Production No. TU.340/28/E/01.2002 dated January 24, 2002 on the Temporary Suspension of the Entry of Ruminansia and their Products from Countries Infected by BSE;
- 2. International Animal Health Code/OIE on Requirements on the Traffic of Animals and Animal Products related to BSE;
- 3. Notification of Emergency Measures to World Trade Organization (WTO) on the Temporary Suspension of the Entry of Animals and Animal Products from Certain Countries Infected by BSE into Indonesia dated February 12, 2001;
DECIDES:
To stipulate:
FIRST:
Banning the entry of ruminansia and its products from countries declared infected by BSE.
SECOND:
The kinds of ruminansia breeding animals banned from being brought into the territory of the Unitary State of the Republic of Indonesia as written in an attachment to this decree.
THIRD:
Based on report of CIE, the Director General of the Fostering of Breeding Animal Production stipulates a list of countries infected by BSE.
FOURTH:
This decree starts to be effective on the date of stipulation.
